Description: Aquaculture Permit Area are issued in those portions of Broward, Charlotte, Collier, Glades, Hendry, Highlands, Lee, Martin, Miami-Dade, Monroe, Okeechobee, Orange, Osceola, Palm Beach, Polk, St. Lucie under the jurisdiction of South Florida Water Management District (SFWMD). These permits are required for construction and operation of fish farms producing either native or non-native fish in freshwater. Excludes flow through systems with surface water discharges, new on-line impoundments, farms with more than 300 acres of ponds, farms with more than 100,000 pounds production per year which discharge to surface waters more than 30 days per year, and farms with individual ponds that have more than 30 days of non-storm induced discharges into water of the state per year. Excluded facilities are required to apply for a standard industrial wastewater permit. This general permit is an alternative to a standard Industrial Water permit to construct or operate an industrial wastewater facility. The rule includes an exemption from permitting for farms that grow only native fish, have less than 10 acres of ponds, and produce less than 10,000 pounds of fish per year; farms that produce less than 10,000 pounds of fish per year (native or non-native) and do not discharge to surface waters; and fee-fishing operations with less than 1,000 pounds standing crop fish per acre. An Environmental Resource Permit or Wetland Resource Permit also is required to construct, alter or modify any fish farm facilities. Aquaculture permits are a special category of Environmental Resource Permits.
