Description: Aquaculture Permit Area are issued in those portions of Broward, Charlotte, Collier, Glades, Hendry, Highlands, Lee, Martin, Miami-Dade, Monroe, Okeechobee, Orange, Osceola, Palm Beach, Polk, St. Lucie under the jurisdiction of South Florida Water Management District (SFWMD). These permits are required for construction and operation of fish farms producing either native or non-native fish in freshwater. Excludes flow through systems with surface water discharges, new on-line impoundments, farms with more than 300 acres of ponds, farms with more than 100,000 pounds production per year which discharge to surface waters more than 30 days per year, and farms with individual ponds that have more than 30 days of non-storm induced discharges into water of the state per year. Excluded facilities are required to apply for a standard industrial wastewater permit. This general permit is an alternative to a standard Industrial Water permit to construct or operate an industrial wastewater facility. The rule includes an exemption from permitting for farms that grow only native fish, have less than 10 acres of ponds, and produce less than 10,000 pounds of fish per year; farms that produce less than 10,000 pounds of fish per year (native or non-native) and do not discharge to surface waters; and fee-fishing operations with less than 1,000 pounds standing crop fish per acre. An Environmental Resource Permit or Wetland Resource Permit also is required to construct, alter or modify any fish farm facilities. Aquaculture permits are a special category of Environmental Resource Permits.

Description: Dredge and Fill Permit Area. Dredge and Fill Permit Area are issued in those portions of Broward, Charlotte, Collier, Glades, Hendry, Highlands, Lee, Martin, Miami-Dade, Monroe, Okeechobee, Orange, Osceola, Palm Beach, Polk, St. Lucie under the jurisdiction of South Florida Water Management District (SFWMD). These permits are no longer being issued; they were incorporated into the Environmental Resource Permitting program in 1995. Originally, these permits were issued for work conducted in "Waters of the State" (lakes, rivers, streams, canals, etc.) by the Florida Department of Environmental Protection (FDEP). In addition to the Dredge and Fill permit, the District usually issued a stormwater management permit that encompassed all of the development, including FDEP's dredge and fill permitted activities. The FDEP eventually delegated the dredge and fill permitting to the water management districts, so the districts would issue both the stormwater management permit and the dredge and fill permit. In 1995 dredge and fill permits were incorporated into the Environmental resource Permitting program. These permits were required for dredging, filling and construction of structures within the landward extent of wetlands and other surface waters unless the activity specifically qualifies for one of the exemptions described below. This included work in isolated wetlands throughout the state, except within the jurisdictional territory of the SFWMD, and activities which qualified for the grandfathering criteria in Sections 373.414(11), (12)(a), (13), (14), (15) or (16), Florida Statutes. This included the excavation (dredging) of channels, canals, ditches, lakes; deposition of fill; construction of docks, fishing and observation piers, wharves, mooring piles, dolphins, boardwalks, platforms, artificial reefs, navigational markers and signs, boat ramps, fences, dams,jetties, groins, dikes, bridges, utility lines, mines, salvage operations, including treasure salvage; or other dredging or filling activities in or connecting to jurisdictional waters. "Dredging" is defined as the excavation, by any means, in wetlands or other surface waters. It also includes the excavation, or creation, of a water body which is, or is to be, connected to waters, directly or via an excavated water body or series of excavated water bodies. [Florida Administrative Code Rule 17-312.020(6)]. "Filling," is defined as the deposition, by any means, of materials in waters. [Florida Administrative Code Rule 17-312.020(10)]. "Materials" includes pilings, but excludes the placement of crab traps, similar devices, and oyster cultch [Florida Administrative Code Rule 17-312.020(13)].</

Description: Environmental Resource Permit Application Boundaries. Environmental Resource Permits are issued in those portions of Broward, Charlotte, Collier, Glades, Hendry, Highlands, Lee, Martin, Miami-Dade, Monroe, Okeechobee, Orange, Osceola, Palm Beach, Polk, and St. Lucie under the jurisdiction of South Florida Water Management District (SFWMD). An Environmental Resource Permit (ERP) is required before beginning any construction activity that would affect wetlands, alter surface water flows or contribute to water pollution. An ERP covers activities such as dredging and filling in wetlands, constructing flood protection facilities, providing stormwater containment and treatment, site grading, building dams or reservoirs, and other activities affecting state waters. The ERP combines wetland resources permitting with management and storage of surface waters permitting into a single permit, to streamline the permitting process.

Description: Formal wetland determination. 373.421 Delineation methods; formal determinations.-- (1) The Environmental Regulation Commission shall adopt a unified statewide methodology for the delineation of the extent of wetlands as defined in s. 373.019(25). This methodology shall consider regional differences in the types of soils and vegetation that may serve as indicators of the extent of wetlands. This methodology shall also include provisions for determining the extent of surface waters other than wetlands for the purposes of regulation under s. 373.414. This methodology shall not become effective until ratified by the Legislature. Subsequent to legislative ratification, the wetland definition in s. 373.019(25) and the adopted wetland methodology shall be binding on the department, the water management districts, local governments, and any other governmental entities. Upon ratification of such wetland methodology, the Legislature preempts the authority of any water management district, state or regional agency, or local government to define wetlands or develop a delineation methodology to implement the definition and determines that the exclusive definition and delineation methodology for wetlands shall be that established pursuant to s. 373.019(25) and this section. Upon such legislative ratification, any existing wetlands definition or wetland delineation methodology shall be superseded by the wetland definition and delineation methodology established pursuant to this chapter. Subsequent to legislative ratification, a delineation of the extent of a surface water or wetland by the department or a water management district, pursuant to a formal determination under subsection (2), or pursuant to a permit issued under this part in which the delineation was field-verified by the permitting agency and specifically approved in the permit, shall be binding on all other governmental entities for the duration of the formal determination or permit. All existing rules and methodologies of the department, the water management districts, and local governments, regarding surface water or wetland definition and delineation shall remain in full force and effect until the common methodology rule becomes effective. However, this shall not be construed to limit any power of the department, the water management districts, and local governments to amend or adopt a surface water or wetland definition or delineation methodology until the common methodology rule becomes effective. (2) A water management district or the department may provide a process by rule for formal determinations of the extent of surface waters and wetlands, as delineated in subsection (1). By interagency agreement, the department and each water management district shall determine which agency shall implement the determination process within the district. If a rule is adopted, a property owner, an entity that has the power of eminent domain, or any other person who has a legal or equitable interest in property may petition the district for a formal determination. In such rule, the governing board or the department shall specify information which must be provided and may require authorization to enter upon the property. The rule shall also establish procedures for issuing a formal determination. The governing board may authorize its executive director to issue formal determinations. The governing board must by rule prescribe the circumstances in which its executive director may issue such determinations. The governing board or the department may require a fee to cover the costs of processing and acting upon the petition. That fee must be established by rule. A water management district or the department may publish, or require the petitioner to publish at the petitioner's expense, notice of the intended agency action on the petition for a formal determination in a newspaper of general circulation within the affected area. Within 60 days prior to the expiration of a formal determination, the property owner, an entity that has the power of eminent domain, or any other person who has a legal or equitable interest in the property may petition for a new formal determination for the same parcel of property and such determination shall be issued, approving the same extent of surface waters and wetlands in the previous formal determination, as long as physical conditions on the property have not changed, other than changes which have been authorized by a permit pursuant to this part, so as to alter the boundaries of surface waters or wetlands and the methodology for determining the extent of surface waters and wetlands authorized by subsection (1) has not been amended since the previous formal determination. The application fee for such a subsequent petition shall be less than the application fee for the original determination.

(6) The district or the department may also issue nonbinding informal determinations or otherwise institute determinations on its own initiative as provided by law. A nonbinding informal determination of the extent of surface waters and wetlands issued by the South Florida Water Management District or the Southwest Florida Water Management District, between July 1, 1989, and the effective date of the methodology ratified in s. 373.4211, shall be validated by the district if a petition to validate the nonbinding informal determination is filed with the district on or before October 1, 1994, provided: (a) The petitioner submits the documentation prepared by the agency, and signed by an agency employee in the course of the employee's official duties, at the time the nonbinding informal determination was issued, showing the boundary of the surface waters or wetlands; (b) The request is accompanied by the appropriate fee in accordance with the fee schedule established by district rule; (c) Any supplemental information, such as aerial photographs and soils maps, is provided as necessary to ensure an accurate determination; (d) District staff verify the delineated surface water or wetland boundary through site inspection; and (e) Following district verification, and adjustment if necessary, of the boundary of surface waters or wetlands, the petitioner submits a survey certified pursuant to chapter 472, which depicts the surface water or wetland boundaries. The certified survey shall contain a legal description of, and the acreage contained within, the boundaries of the property for which the determination is sought. The boundaries must be witnessed to the property boundaries and must be capable of being mathematically reproduced from the survey. Validated informal nonbinding determinations issued by the South Florida Water Management District and the Southwest Florida Water Management District shall remain valid for a period of 5 years from the date of validation by the district, as long as physical conditions on the property do not change so as to alter the boundaries of surface waters or wetlands. A validation obtained under this section is final agency action. Sections 120.569 and 120.57 apply to validations under this section.

Permits are required to construct, alter, operate, maintain, abandon, or remove any surface water necessary to establish and operate a mitigation bank. The applicant must demonstrate several factors to qualify for a mitigation bank permit including sufficient legal or equitable interest in the land to ensure perpetual protection and the ability to meet the financial responsibility assigned to mitigation banks.

One-Stop Permits are issued in those portions of Broward, Charlotte, Collier, Glades, Hendry, Highlands, Lee, Martin, Miami-Dade, Monroe, Okeechobee, Orange, Osceola, Palm Beach, Polk, St. Lucie under the jurisdiction of South Florida Water Management District (SFWMD). The One Stop Permit (OSTOP) is required before beginning any construction activities for 1.Power Plant and Transmission Line, 2. Natural Gas Pipelines, 3. High Speed Rail, 4. Hazardous Waste Facility. The One Stop permit is an umbrella permit for all affected state, regional and local agencies, and includes any regulatory activity which would be applicable under these agencies regulations for the facility. Certification can also include authorization to use or connect to lands or works of state agencies. It is a life-of-the-facility approval, authorizing construction, operation, and maintenance of the facility. The Department of Environmental Protection is the lead agency responsible for coordinating the interagency review and certification. However the permit is issued by the Governor & Cabinet.

Description: Pre-planning application locations. This data set depicts the location of pre-applications. The regulatory review process can usually be expedited if the applicant elects to participate in a pre-application conference with District engineers and environmental scientists early in the project planning process. A meeting with District staff can help the applicant and the project designers to better understand District rules and regulations, and help District staff understand the project. The District staff can outline procedures to facilitate submittal of a complete application or explain permitting requirements, as needed. Any potential permitting problems could be identified at the meeting.

Description: Submerged Lands Environmental Resource Permits. Submerged Lands Environmental Resource Permits are issued in those portions of Broward, Charlotte, Collier, Glades, Hendry, Highlands, Lee, Martin, Miami-Dade, Monroe, Okeechobee, Orange, Osceola, Palm Beach, Polk, St. Lucie under the jurisdiction of South Florida Water Management District (SFWMD). A Submerged Land Environmental Resource Permit (SLERP) is needed to regulate activities such as dredging and filling in wetlands, construction of drainage facilities, stormwater containment and treatment, construction of dams or reservoirs, and other activities affecting state waters and submerged lands. If the proposed activities involve works in adjacent water bodies, the districts will generally request a title determination from the state of Florida as to whether the state has any claim to the submerged lands. If the state claims title to the submerged lands, the districts will also process any required authorizations from the state for use of the submerged lands. These authorizations can include consents of use, easements and leases, and must be processed concurrently with an ERP application.
