Abstract: Delineates areas to Broward County under part IV of Chapter 373, F.S. (ERP) per the agreement by the South Florida Water Management District, Broward County and the Department of Environmental Protection as defined by the 1998 document authorizing Broward County to perform permitting, compliance & enforcement responsibilities within all of Broward County with the exception of projects retained by the DEP, the SFWMD, and specific geographic areas. The agreement also delegates to Broward County the compliance and enforcement of Environmental Resource Permitting (ERP), Dredge and Fill (DF) & Management and Storage of Surface Waters(MSSW) permits previously issued by DEP/SFWMD, Formal Wetland determinations, and specific variances for mixing zones, turbidity & dissolved oxygen (D.O.). This feature class also contains the historical delegated areas for ERP between SFWMD and Miami-Dade County; and between SFWMD and Collier County which are no longer in effect. Purpose: To delineate areas for Environmental Resource Permitting (ERP) and compliance responsibilities delegated per the agreement between Broward County, the South Florida Water Management District (SFWMD), and the Department of Environmental Protection (DEP). This feature class also contains a proprietary delegation boundary per a Memorandum of Agreement (MOA) between the South Florida Water Management District (SFWMD), the Department of Environmental Protection (DEP).

South Florida Water Management District (Operating Agreement) - Project/Activity SpecificBroward County (Delegation) - Geographically Specific, ERP's not on State owned submierged lands, ERP's not located within Special Drainage Districts, etc., Mangrove TrimmingProjects retained by the DEP - permits for solid waste management facilities; permits for hazardous waste facililites; permits for domestic or industrial wastewater treatment; storage, transmission, etc.; permits for potable water facilities; permits for mines, power plants and electrical distribution and transmission lins and facilities related to production; transmission; and distribution of electricity, communication cables and lines (unless part of larger development); natural gas or petroleum projects, docking facilities, shoreline protection projects, dredging projects as long as 1: not part of a larger plan of commercial/residential development, 2: Any type of the above listed project if part of dwelling unit; systems that require a JCP Permit through Beaches & Coastal Program; Projects constructed, operated and maintained by the District' Navigational dredging projects associated with gov't,. entities - unless part of a larger development; Seaports and adjacent seaport development where applicant/property owner is a port authority; system serving up to 3 contiguous parcels o fland under single ownership; ski jumps and courses, moorings bouys and fields, boat ramps, aids to navigation, aquatic plant management activities, fish attractors, artificial reefs, treasure salvage, archaeological research and exploration, removal of organic detrital material (unless part of a larger developement); temporary systems associated with commercial fil productions; high speed rail facilities under Section 341.8201 through 341.842 F.S.; aquaculture activities not exempt; all activities on sovereignty submerged lands leased by Division of Recreation and Parks, except those proposed by the DEP.Geographical Exceptions (to be permitted by SFWMD & DEP)Independent Water Control/Drainage Districts, Special Taxing Districts, Everglades Buffer Strip, Water Conservation Areas, Seminole Indian Reservation Lands, Presumed Soverign Submerged Lands (Lake Placid,Lake Sylvan, Middle River (inclding North & South Forks), Mayan Lake, New River (including North & South Forks), Osceola Creek, Pond Apple Slough, Stranahan River, Tarpon River, Three Islands)State & Local Authorization combined:As applicable, Broward County will issue: A state Verification of Exemption, Environmental Resource General Permit, or Environmental Resource Indiviual Permit with their County Envornmental Resource Lincense, or Surface Water Management License as a single document.ERP Applications for activities on aretifical waterways or within delegation boundaries should be submitted to Broward county's Planning & Environmental Regulation Division Aquatic & Wetland Resources ProgramActivities on Sovereign Submerged Lands or within excluded areas should be submitted to DEP or SFWMD (per operating agreement)
A Broward County owned canal requiring an ERP and Broward County is the applicant, SFWMD does the permitting. If it is an SFWMD owned canal requireing an ERP and SFWMD is the applicant, Broward County does the permitting.
All Rights-of-Ways in an SFWMD canal are handeled by the SFWMD Rights-of-Way permitting staff.
